Terms & Conditions

Last updated: 17 October 2026

These General Terms and Conditions of Sale govern the distance selling of the programs and coaching offered on yogawithclem.com. Please read them before ordering: by confirming your payment, you accept them.

This is an English translation of the French Conditions Générales de Vente, provided for your convenience. If the two versions differ, the French version prevails.

Article 1 — Seller identification

Seller: Clémence Dieryck, sole trader under the French micro-enterprise scheme.

Address: 43 rue François de Guillebon, 59110 La Madeleine, France.

SIRET: 105 184 725 00015.

Contact: hello@yogawithclem.com.

VAT: VAT not applicable, article 293 B of the French General Tax Code.

Website hosting: Vercel Inc., 340 S Lemon Ave #4133, Walnut, CA 91789, United States.

Article 2 — Purpose and acceptance

These terms govern the distance sale, to consumers, of the services and digital content offered by the seller: online yoga programs, coaching and subscriptions.

Any order implies full and unreserved acceptance of these terms. The applicable version is the one online on the day of the order; a later change has no effect on orders already placed.

The sales page of each offer (description of the content, schedule, access period, price) forms an integral part of the contract and supplements these terms.

Article 3 — Description of the services

The services offered are yoga and well-being coaching programs, delivered entirely online. Depending on the offer, they may include video sessions, documents, an online community space, answers to the group's questions and personal feedback.

They require an internet connection, a recent browser and, where applicable, installing the app indicated on the sales page. The equipment needed for the practice (mat, cushion or blanket) is your responsibility.

Article 4 — Order

Orders are placed on a payment page hosted by the ThriveCart platform: you enter your details there, confirm your payment, and receive a confirmation email summarising your purchase. The order is firm and final once payment is confirmed, subject to the right of withdrawal provided for in article 7.

Some offers have a limited number of places, stated on the sales page; orders are then fulfilled in the order in which they are received. The seller reserves the right to refuse an order in the event of an unresolved earlier dispute or a clearly abnormal request.

Article 5 — Prices and payment

Prices are stated in euros, all taxes included. Under article 293 B of the French General Tax Code, VAT is not applicable. The applicable price is the one displayed at the time of the order.

Promotional prices, including launch prices, are only valid until the date and time announced on the sales page. After that, the full price applies automatically.

Payment is made in a single instalment by bank card at the time of the order, through the ThriveCart platform and its payment provider. Card details are processed directly by that provider under its own security protocols; the seller never has access to them and keeps no copy. Unless expressly stated on the sales page, no instalment plan is offered.

Article 6 — Access to the service

Your access details are sent by email to the address given when ordering. It is your responsibility to check that this address is correct and, where necessary, your spam folder. If you do not receive them, write to hello@yogawithclem.com.

The date on which access opens and the period during which the content remains available are stated on the sales page and repeated, for each program, in the specific conditions.

Access is personal, individual and non-transferable. It is for your use only and may not be shared, lent or resold.

Article 7 — Right of withdrawal

In accordance with articles L.221-18 et seq. of the French Consumer Code, you have fourteen (14) days from the conclusion of the contract, that is, from the date of your order, to exercise your right of withdrawal, without having to give reasons or pay any penalty.

To exercise it, simply send an unambiguous statement to hello@yogawithclem.com before this period expires. You may use the model form in the appendix to these terms, but you are not required to.

The refund is made in full no later than fourteen (14) days after your decision is received, using the same means of payment as for the order, at no cost to you.

For offers whose access only opens on an announced start date, you are not asked to waive this right: performance of the service does not begin before that date.

For digital content supplied immediately after the order, identified as such in the specific conditions, the right of withdrawal cannot be exercised once access has opened, provided that, at the time of the order, you gave your prior express consent to this immediate performance and acknowledged that you would lose your right of withdrawal (article L.221-28, 13° of the French Consumer Code). This consent is confirmed to you in the order confirmation email.

Article 8 — Commercial “satisfied or your money back” guarantee

In addition to the legal right of withdrawal provided for in article 7, and without replacing it, the seller grants a commercial satisfaction guarantee, except for offers whose specific conditions expressly exclude it.

If, within fourteen (14) days of the program's start date, you find after following the sessions that it does not suit you, simply write to hello@yogawithclem.com to obtain a full refund of your order. No particular proof is required.

This guarantee is a voluntary contractual commitment by the seller, separate from and in addition to the legal right of withdrawal. It does not restrict your legal rights in any way, in particular the right of withdrawal in article 7, the legal guarantee of conformity and the guarantee against hidden defects.

Article 9 — Health, non-medical nature and liability

The programs offered are yoga and well-being coaching programs. They are not a medical act, a diagnosis, a treatment or medical advice, and in no case replace a consultation, examination or follow-up with a health professional. The term “therapeutic”, where used, refers to an approach to yoga adapted to the person, not to a regulated medical or paramedical practice.

Before starting, it is your responsibility to make sure that your state of health allows you to take part in physical activity, and to seek a doctor's advice if in doubt. This advice is strongly recommended, in particular in the event of acute or sudden pain, pain radiating into a limb, a recent injury or surgery, a diagnosed back condition, pregnancy, high blood pressure or any chronic condition.

The practice takes place remotely, at your own pace and under your sole responsibility, without physical supervision or direct monitoring by the seller. It is your responsibility to adapt the movements to your abilities, never to force, and to stop any session immediately in the event of pain or discomfort.

No result is guaranteed. The effects of a practice depend on individual factors (regularity, state of health, build, lifestyle) beyond the seller's control. Published testimonials describe individual experiences and are not a promise of results.

The seller cannot be held liable for any damage resulting from failure to follow the safety instructions, from a practice unsuited to your state of health, or from the absence of prior medical advice where it was recommended.

Article 10 — Intellectual property and use

All the content made available (videos, audio recordings, texts, documents, visuals, programs) is protected by copyright and remains the exclusive property of Clémence Dieryck.

Your purchase grants you a personal, private, non-exclusive and non-transferable licence to use it, for the access period provided only. The following are prohibited in particular, unless prior written permission is given: reproduction, downloading other than of content explicitly made available for that purpose, distribution, posting online, resale, sharing of login details, and any use for commercial or teaching purposes.

Sharing access with a third party leads to immediate suspension of the account, without refund.

Where a community space is offered, you agree to behave respectfully there, not to post any insulting, defamatory or discriminatory remarks, not to carry out any commercial promotion and not to redistribute any program content. A serious breach may lead to exclusion from the space, without refund.

Article 11 — Availability, changes and force majeure

The seller makes every effort to ensure access to the content for the announced period. Interruptions may nevertheless occur, in particular for maintenance or because of a third-party technical provider; as long as they last a reasonable time, they do not give rise to compensation.

The seller may adjust the schedule or content of a program, provided that this does not reduce its substance or the essential features announced at the time of the order.

If the seller had to cancel a session (too few participants, unavailability, force majeure), you would be informed as soon as possible and could choose between moving to a later session and a full refund.

Neither party is liable for a failure due to force majeure within the meaning of article 1218 of the French Civil Code.

Article 12 — Personal data

The data collected when ordering is needed to process the order and provide the service. It is processed in accordance with the General Data Protection Regulation. The data controller is Clémence Dieryck.

You have the right of access, rectification, erasure, restriction, objection and portability, which you can exercise at hello@yogawithclem.com. You may also lodge a complaint with the CNIL, the French data protection authority.

Details of the processing, its purposes and retention periods are set out in the privacy policy.

Article 13 — Complaints and consumer mediation

For any complaint, please first write to hello@yogawithclem.com: the vast majority of issues are resolved at this stage, and you will receive a reply as soon as possible.

In accordance with article L.612-1 of the French Consumer Code, if the dispute has not been resolved, you may refer it free of charge to the consumer mediator the seller belongs to:

Mediator: [TO BE COMPLETED — name of the mediation body]

Address: [TO BE COMPLETED — postal address of the mediator]

Website: [TO BE COMPLETED — website for referring a case to the mediator]

Mediation is free of charge for the consumer. It requires that a written complaint has first been sent to the seller without a satisfactory reply, and that the request is made within one year of that complaint.

Article 14 — Applicable law and disputes

These terms are governed by French law. If you habitually reside in another member state of the European Union, this clause does not deprive you of the protection afforded by the mandatory provisions of the law of your country of residence.

Failing an amicable settlement, the dispute may be brought before the competent courts under the rules of the French Code of Civil Procedure, it being noted that the consumer may choose to refer the matter to the court of the place where they lived at the time the contract was concluded.

Article 15 — Specific conditions: La Juste Dose, September 2026 cohort

The provisions below supplement articles 1 to 14 and prevail over them in the event of a discrepancy, for this program only.

  • Duration: 4 weeks, from 21 September to 18 October 2026.
  • Content: daily video routines of 5 to 15 minutes, an “SOS Crisis” mode, active breaks at the desk, four “Clem answers” videos, personal feedback in week 3, access to the Yogathèque (video library) and access to the community space.
  • Number of places: 20.
  • Price: €147 including taxes at the launch price until 9 September 2026 at 11:59 pm, then €197 including taxes. Single payment.
  • Access opens: 21 September 2026.
  • End of access: the content, including the community space and the Yogathèque, remains accessible for two weeks after the program's last session, at which point the space is closed. For the September 2026 cohort, which runs from 21 September to 18 October 2026, this deadline is set at 1 November 2026 inclusive. This limited period is an essential feature of the program, announced before ordering, and not a service incident.
  • Before closing, your core routine and your 8-week plan are given to you and remain yours.
  • Right of withdrawal: 14 days from the order (article 7).
  • Commercial guarantee: 14 days from 21 September 2026, the start date (article 8).

Article 16 — Specific conditions: mini-programs

The provisions below supplement articles 1 to 14 and prevail over them in the event of a discrepancy, for the mini-programs only.

  • Programs concerned: “Nuque & écrans”, “Hanches libérées”, “Soirées apaisées”, their English versions “Neck & Shoulders”, “Hips Unlocked” and “Night Ritual”, and any program presented as a mini-program on its sales page.
  • Duration: 12 days of guided video sessions of 10 to 20 minutes, with a longer session offered as an option on some days. You are free to choose your start date.
  • Content: the program's sessions, organised day by day in the Yoga with Clem app, and a summary document in PDF format containing the links to the program's videos, provided with the order confirmation. The community space, the Yogathèque, exchanges with the teacher and any personal feedback are not included.
  • Price: €24 including taxes per program. Single payment, no subscription.
  • Access opens: immediately, as soon as payment is confirmed. Access details are sent by email.
  • Access period: no time limit. The program remains accessible in the app, and can be started again, for as long as the app is operated by the seller. The summary document lets you follow the program independently of the app.
  • Right of withdrawal: the mini-program is digital content supplied immediately. When ordering, you expressly request access without waiting for the withdrawal period to expire and acknowledge that you lose this right once access opens (article 7 and article L.221-28, 13° of the French Consumer Code). This consent is confirmed to you in the order confirmation email.
  • Commercial guarantee: the “satisfied or your money back” guarantee in article 8 does not apply to mini-programs.
  • Legal guarantees: the legal guarantee of conformity for digital content still applies.
